Tender Loving Caregivers ("TLC", "we", "us", or "our") is committed to protecting your privacy. This Privacy Policy explains what personal information we collect, how we use it, who we share it with, and the rights you have regarding that information when you use our platform at thetenderlovingcaregivers.com.
1. Information We Collect
We collect information you provide directly to us when you register or use the platform, including:
- Account information: name, email address, and password (stored as a secure hash).
- Caregiver profile information: phone number, city, bio, years of experience, certifications, gender, services offered, availability schedule, requested hourly rate, and an optional profile photo.
- Client profile information: name, phone number, city, care type, care schedule, and job post details including descriptions of care needs.
- Communications: messages or notes submitted through the platform, such as interest expressions or care request introductions.
- SMS interaction data: records of SMS messages sent by TLC to your phone number, including delivery status, your opt-in/opt-out preference, and any reply keywords (e.g., STOP, START).
We also collect certain information automatically when you use the platform, including your IP address, browser type, and session activity, which we use solely for security and platform operation purposes.
2. How We Use Your Information
We use the information we collect to:
- Create and manage your account on the platform.
- Match Clients with suitable Caregivers based on care needs, availability, and location.
- Review and approve Caregiver profiles before they are made visible on the platform.
- Send transactional email notifications related to job interest, match confirmations, and account activity.
- Send SMS notifications to Caregivers about new care opportunities (subject to your consent and opt-in status).
- Respond to inquiries, support requests, or complaints submitted to us.
- Maintain the security and integrity of our platform.
- Comply with applicable legal obligations.
We do not use your information for automated profiling or decision-making that produces legal or similarly significant effects on you.
3. SMS & Text Message Communications
By providing your phone number when registering as a Caregiver, you consent to receive SMS text messages from Tender Loving Caregivers about new care opportunities and platform notifications.
The following applies to all SMS communications from TLC:
- Purpose: We send SMS messages to notify Caregivers of new care opportunities that may be a match for their skills and availability.
- Frequency: Message frequency varies and depends on the number of new care opportunities posted. You may receive several messages per month during active periods.
- Message and data rates: Standard message and data rates may apply depending on your mobile carrier plan.
- Opt-out: You may opt out at any time by replying STOP to any SMS from TLC. You will receive one confirmation message, and no further messages will be sent unless you re-subscribe.
- Re-subscribe: Reply START to re-enable SMS notifications after opting out.

- Carrier disclaimer: Carriers are not liable for delayed or undelivered messages.
Your phone number and SMS interaction data (including opt-out status) are stored securely in our platform database. We do not sell or share your phone number with third parties for their own marketing purposes. SMS messages are delivered through Twilio (see Section 6 for more information).
4. Email Communications
By creating an account, you agree to receive transactional emails from TLC. These include:
- Account notifications: Confirmation of registration, approval status updates, and account changes.
- Match notifications (Clients): Alerts when a Caregiver expresses interest in your care post, or when a match is confirmed.
- Job notifications (Caregivers): Alerts when your application status changes or when a Client accepts your care request.
- Platform communications: Important notices regarding changes to our terms, policies, or platform features.
Transactional emails are necessary for the operation of the platform and cannot be opted out of independently while your account remains active. If you no longer wish to receive any email communications from TLC, you may request account deletion by contacting us at platform@thetenderlovingcaregivers.com.
We do not send marketing or promotional emails to users without explicit consent beyond what is described above. All emails are sent from platform@thetenderlovingcaregivers.com. We recommend adding this address to your contacts to avoid messages being filtered as spam.
5. How We Share Your Information
We do not sell your personal information to third parties. We may share your information only in the following limited circumstances:
- Between matched users: When a Client accepts a Caregiver's care request, relevant contact information (name, phone number, email) is shared between both parties to facilitate the care arrangement directly.
- With our internal team: Our admin team reviews profiles and applications to ensure platform quality and safety.
- Service providers: We use trusted third-party providers who process data on our behalf (see Section 6). These providers are contractually required to protect your data and may not use it for their own purposes.
- Legal requirements: We may disclose information if required to do so by law, court order, or governmental authority, or to protect the rights, property, or safety of TLC, our users, or the public.
- Business transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you before your information is subject to a different privacy policy.
6. Third-Party Service Providers
We work with the following categories of third-party service providers to operate our platform:
- SMS messaging — Twilio: We use Twilio to send and receive SMS messages. When you receive or reply to an SMS from TLC, that message is processed through Twilio's infrastructure. Twilio may retain message logs in accordance with their own privacy policy, available at twilio.com/legal/privacy.
- Web hosting: Our platform is hosted on a cPanel-based web hosting provider. Server logs may contain IP addresses and request metadata.
- Email delivery: Transactional emails may be delivered through server-side mail infrastructure. We do not use third-party email marketing platforms.
All service providers are selected for their commitment to data protection and are prohibited from using your data for purposes beyond those we specify.
7. Data Retention
We retain your personal information for as long as your account is active or as needed to provide services. Specifically:
- Account and profile data: Retained while your account is active and for up to 12 months after deletion, to comply with legal obligations and resolve disputes.
- SMS logs: Records of sent messages are retained for up to 24 months for compliance and troubleshooting purposes.
- Email correspondence: Email notifications are logged for up to 12 months.
- Opt-out records: Records of SMS opt-outs (STOP requests) are retained indefinitely to ensure we do not contact users who have requested to stop receiving messages.
To request deletion of your account and personal data, please contact us at platform@thetenderlovingcaregivers.com. We will process deletion requests within 30 days, subject to any legal retention obligations.
8. Security
We implement reasonable technical and organizational measures to protect your personal information, including:
- Passwords stored using industry-standard bcrypt hashing — your plaintext password is never stored.
- Secure HTTPS encryption for all data transmitted between your browser and our platform.
- Session tokens protected with HTTP-only, secure cookies.
- Database credentials and API keys stored outside the public web root.
- Access to the admin panel restricted to authorized personnel only.
While we take security seriously, no method of transmission over the internet is 100% secure. We cannot guarantee absolute security, and you use the platform at your own risk. If you believe your account has been compromised, contact us immediately.
9. Cookies & Session Data
We use cookies and similar technologies solely to operate the platform. Specifically:
- Session cookies: Used to keep you logged in while you navigate the platform. These are essential for the platform to function and expire when you close your browser or log out.
- CSRF tokens: We use short-lived tokens stored in your session to protect against cross-site request forgery attacks.
- No tracking or advertising cookies: We do not use cookies for advertising, analytics tracking, or cross-site tracking of any kind. No third-party tracking scripts are loaded on our platform.
By using our platform, you consent to our use of session cookies as described above. You can disable cookies in your browser settings, but doing so will prevent you from logging in or using core platform features.
10. Children's Privacy
Our platform is intended for users who are 18 years of age or older. We do not knowingly collect personal information from children under 18. If you believe a minor has provided us with personal information, please contact us and we will promptly delete it from our systems.
11. Your Rights
Regardless of your location, you have the following rights regarding your personal information held by TLC:
- Access: You may request a copy of the personal information we hold about you.
- Correction: You may request correction of inaccurate or incomplete information. Caregivers may update their profile by logging into their dashboard.
- Deletion: You may request deletion of your account and associated personal data.
- SMS opt-out: You may opt out of SMS communications at any time by replying STOP to any message from us.
- Portability: You may request a copy of your data in a commonly used format.

12. California Privacy Rights (CCPA)
If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA):
- Right to Know: You have the right to know what personal information we collect about you, how it is used, and with whom it is shared.
- Right to Delete: You have the right to request deletion of your personal information, subject to certain legal exceptions.
- Right to Opt-Out of Sale: We do not sell your personal information. You therefore do not need to take any action to opt out of the sale of your data.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights.

13. Changes to This Policy
We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. We encourage you to review this page periodically. Continued use of the platform after any changes constitutes your acceptance of the updated policy.
