Tender Loving Caregivers is an online marketplace that connects families and individuals ("Clients") seeking in-home care services with independent caregivers ("Caregivers"). TLC facilitates introductions and matches between Clients and Caregivers but does not employ Caregivers directly, nor does it provide care services itself.
By using this platform, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. Caregivers must be legally authorized to work in the United States and located in or near the service areas supported by TLC (primarily the San Francisco Peninsula and South Bay regions of California).

We reserve the right to suspend or terminate accounts that violate these terms or that we determine, in our sole discretion, are harmful to other users or the platform.
Caregivers are required to submit a profile for review by the TLC team before being approved on the platform. While we make reasonable efforts to review caregiver profiles for quality and authenticity, TLC does not conduct formal background checks, verify credentials, or guarantee the accuracy of any information provided by Caregivers. Clients are encouraged to conduct their own due diligence before engaging any Caregiver.
Any care arrangement made through TLC is an agreement solely between the Client and the Caregiver. TLC is not a party to those arrangements and is not responsible for the performance, quality, or outcome of any care services rendered. Caregivers operate as independent contractors, not as employees of TLC.
By providing your phone number and registering on this platform, you consent to receive SMS text messages from Tender Loving Caregivers regarding care opportunities, platform updates, and account-related notifications.
The following terms apply to all SMS communications sent by TLC:
TLC sends SMS messages through Twilio, a third-party messaging provider. Your phone number may be processed by Twilio in accordance with their privacy policy. TLC does not sell your phone number to third parties for marketing purposes.
By creating an account on TLC, you agree to receive transactional emails related to your account, including:
Transactional emails are necessary for the functioning of the platform and cannot be fully opted out of while your account is active. If you wish to stop receiving all communications from TLC, you may request account deletion by contacting us at platform@thetenderlovingcaregivers.com.

All content on this platform — including text, graphics, logos, and software — is the property of Tender Loving Caregivers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
To the fullest extent permitted by law, TLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, any care arrangement made through it, or any communications sent or received through the platform. Our total liability to you for any claim arising from use of the platform shall not exceed the amount, if any, paid by you to TLC in the twelve months preceding the claim.
The platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranty regarding the quality, suitability, or availability of any Caregiver listed on the platform.
You agree to indemnify, defend, and hold harmless TLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the platform, your violation of these Terms, or your violation of any rights of another party.
Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the platform, you consent to the data practices described in our Privacy Policy.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the platform after any changes constitutes your acceptance of the new terms. We encourage you to review this page periodically.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts located in Santa Clara County, California.
